Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Angana Buddika Galboda Liyanage, trading as ARCNOVA (ABN 12517518318) ("Mixr," "we," "us") governing your access to and use of the Mixr mobile application and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

Note on business structure: ARCNOVA is a registered business name held by an individual (sole trader), not an incorporated company. That means there's no separate corporate entity shielding personal assets from business liability the way a Pty Ltd would.

1. Eligibility & Accounts

• You must be at least 16 years old to use Mixr. (Enforced at sign-up: email sign-up requires a date of birth, validated against the minimum age and never stored; Google sign-in requires a one-time 16+ confirmation.)
• You may create an account with an email/password or by signing in with Google. You're responsible for keeping your credentials secure and for all activity under your account.
• You must provide accurate information (name, headline, bio) and keep it up to date. Impersonating another person or organization is prohibited.
• One account per person. We may suspend or terminate accounts that violate these Terms (see Section 9).

2. The Service

Mixr is a professional social network. Depending on your subscription tier, the Service includes:

• Feed & posts — publishing posts, reacting to and commenting on others'.
• Connections — sending and accepting connection requests with other users.
• Messaging — one-to-one direct messages, and group chats you create or are added to. Group creators can rename the group and add or remove members; any member may leave a group at any time.
• Job board — browsing job postings, posting jobs (if permitted by your tier), and submitting applications.
• Search & profile views — finding other users and, on eligible tiers, seeing who's viewed your profile.

We may add, change, or remove features at any time. We'll try to give notice of material changes but aren't always able to.

3. Subscriptions, Billing & Cancellation

Mixr offers three tiers:

• Paid subscriptions are billed and processed through Google Play Billing. Your purchase, auto-renewal, cancellation, and refund rights for the subscription itself are governed by Google Play's terms and billing policies, not by us directly — cancel or manage your subscription through the Google Play Store app.
• Subscriptions auto-renew at the then-current price until you cancel. Cancelling stops future renewals but doesn't refund the current billing period unless required by law or Google Play policy.
• We may change subscription pricing or what each tier includes going forward; we'll give notice before a price increase takes effect for existing subscribers, consistent with Google Play's requirements.
• Downgrading or letting a subscription lapse may restrict access to tier-gated features (e.g., messaging, job applications) going forward; it does not delete content you already created.

4. Your Content

• You own the posts, messages, comments, and profile information you submit to Mixr ("User Content").
• By submitting User Content, you grant Mixr a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it solely to operate and provide the Service (e.g., showing your posts in others' feeds, delivering your messages to their recipients). This license ends when you delete the content or your account, except where copies persist in backups or in messages already delivered to other users.
• You're responsible for your User Content and confirm you have the rights to post it and that it doesn't violate these Terms or anyone else's rights.
• We may remove User Content or restrict accounts that violate Section 5.

5. Acceptable Use

You agree not to, on Mixr:

• Harass, threaten, or abuse other users, in posts, comments, direct messages, or group chats.
• Post spam, scams, or fraudulent job postings; misrepresent an employer, job, or your own qualifications.
• Scrape, mass-collect, or resell other users' data or content.
• Upload content that's illegal, infringing, or that you don't have the right to share.
• Attempt to bypass subscription tier limits, security controls, or Firestore access rules by technical means.
• Use the Service to violate any applicable law.

Violations may result in content removal, feature restrictions, or account termination.

6. Job Postings & Applications

• Mixr is a platform, not an employer or employment agency. We don't verify job postings, employers, or applicants, and we're not a party to any employment relationship, offer, or agreement that results from using the job board.
• We don't guarantee the accuracy of job postings or applications, or that any application will result in a job offer or a response from the poster.
• Job posters are solely responsible for the legality and accuracy of their postings (including compliance with employment and anti-discrimination law) and for how they use applicant information they receive (names, contact details, application content) — Mixr does not vet this on their behalf.
• Report suspected scam postings or misuse to buddika@arc-nova.net.

7. Messaging & Groups

• Messages and group chats are private to their participants, but Mixr operates the infrastructure that delivers them and may access content as needed to provide the Service, investigate abuse reports, or comply with law.
• Group creators control group membership and naming; you're responsible for who you add to a group you create.
• We don't guarantee message delivery, persistence, or that participants won't take screenshots or otherwise share what you send them — treat anything you send as something the recipient(s) can retain.

8. Intellectual Property

The Mixr name, logo, and app design are owned by Angana Buddika Galboda Liyanage, trading as ARCNOVA, and protected by trademark and copyright law. These Terms don't grant you any right to use Mixr's branding except as needed to use the Service normally.

9. Termination

• You may delete your account at any time from the app.
• We may suspend or terminate your account for violating these Terms, for extended inactivity, or to comply with law.
• On termination, your right to use the Service ends immediately. Some content may persist (e.g., messages already delivered to other users, data retained as required by law or our Privacy Policy).

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, secure, or error-free, or that job postings, applications, or other users' content are accurate or safe.

11. Limitation of Liability

To the maximum extent permitted by law, Angana Buddika Galboda Liyanage (trading as ARCNOVA) will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of $100 or the amount you paid us in the 12 months before the claim arose.

12. Indemnification

You agree to indemnify and hold Angana Buddika Galboda Liyanage (trading as ARCNOVA) harmless from claims, damages, and expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of South Australia, Australia, without regard to conflict-of-law principles.

14. Changes to These Terms

We may update these Terms from time to time. We'll post the updated version at /terms and update the "Last updated" date above. Material changes will be flagged in-app or by push notification. Continued use of the Service after changes take effect means you accept the updated Terms.
